A25/16 MINUTES OF THE LICENSING COMMITTEE

The Committee RESOLVED to approve the minutes as a correct record of the meeting.

There was no urgent business.

A27/16 DISCLOSURE OF INTEREST

Councillor O'Connell disclosed that he regularly attended a coffee house in Purley and would therefore not take part in the discussion at item 7 regarding trading establishments on Purley High Street.

 

Councillor Neal disclosed that he was a food safety trainer at the Chartered Institute for Environmental Health (CIEH).

The Committee agreed to the allocation of business between Part A and Part B as stated in the agenda.

A29/16 MINUTES OF THE LICENSING SUB-COMMITTEE

The Committee RESOLVED to approve the minutes of the Licensing Sub-Committee held on 6 September 2016 as a correct record.

A30/16 LONDON LOCAL AUTHORITIES ACT 1990: APPLICATIONS FOR STREET DESIGNATION ORDERS

The Committee considered the application for a street designation order for 141a Wickham Road.

 

The Licensing Manager introduced the item and stated that before a street designation licence could be granted, the Committee must first decide whether to designate the site for the purposes of street trading. If the Committee were minded to so designate, the application for a licence would be considered. The application was for tables and chairs to be located outside the property - the measurements were fully set out in the report and associated appendices. The applicant held a temporary licence for the chairs and tables and if a licence were granted it would be a condition that a barrier be erected around the designated area. The application had been advertised in the local press and no objections had been received. There were no other local businesses with street trading licences in the immediate vicinity of the property.

 

In response to a question from the Committee, the Licensing Manager confirmed that the measurements for the site took account of the space required for staff to serve food and drink to the tables.

 

The Applicant was present at the hearing, and stated to the Committee that the tables and chairs would be present in the summer months and not during the winter.

 

The Committee RESOLVED:

  1. To designate 141a Wickham Road for the purposes of street trading.
  2. To grant a street trading licence to the Applicant.
     

 

 

The Committee considered the application for a street designation order for 256 High Street.

 

The Licensing Manager introduced the item and stated that the site had originally been before the Licensing Committee but required amendments to the application. The site in question covered two areas: the site on the corner of the road and the site on the High Street. The roads were maintained by the Council and the measurements within the report took account of space for staff to serve customers at the tables. The application had been advertised in the local press and no objections had been received. There was one licensed premises in the vicinity of the site; a public house the other side of West Street.

 

In response to a question from the Committee, the Licensing Manager confirmed that the street trading order would allow for the serving, but not the sale, of alcoholic drinks on the designated site.

 

The Applicant was present at the hearing.

 

The Committee RESOLVED:

  1. To designate 256 High Street for the purposes of street trading.
  2. To grant a street trading licence to the Applicant.
     

 

 

 

The Committee considered the application for a street designation order for 33 Central Parade.

 

The Licensing Manager introduced the item and stated that the road in question was Council maintained. The property already contained a barrier around the designated site and there were two other licensed street trading premises nearby. The application was advertised and no objections were received.

 

The Applicant was not present at the hearing.

 

 

The Committee RESOLVED:

  1. To designate 33 Central Parade for the purposes of street trading.
  2. To grant a street trading licence to the Applicant.

 

 

 

The Committee considered the application for a street designation order for 20 Central Parade.

 

The Licensing Manager introduced the item and stated that there was a licensed premises for street trading next door to the property. The application had been advertised with no objections received.

 

The Applicant was present and confirmed that a barrier would be erected around the site as required.

 

The Committee RESOLVED:

  1. To designate 20 Central Parade for the purposes of street trading.
  2. To grant a street trading licence to the Applicant.
     

 


The Committee considered the application for a street designation order for 4 High Street, Purley.

 

The Licensing Manager introduced the item and stated that the application had been advertised and no objections were received. There were no premises within the vicinity with street trading licenses. It was confirmed that the measurements illustrated within the report took into account the bicycle racks opposite the property.


The Committee RESOLVED:

  1. To designate 4 High Street, Purley for the purposes of street trading.
  2. To grant a street trading licence to the Applicant.
     
A31/16 ADOPTION OF THE MODEL LICENCE CONDITIONS AND GUIDANCE FOR CAT BOARDING ESTABLISHMENTS 2013

The Licensing Manager introduced the item that pertained to the regulation of catteries in the borough. There were standard regulations that formed a part of all licences and the local authority could additionally issue site-specific regulations. In 2002 the Committee adopted the Cat Boarding Establishments rules; these rules had since been updated, which the Committee were being asked to adopt. Catteries licensed in the borough would be expected to follow and uphold these rules.

 

In response to questions from the Committee the following was stated:

  • There were seven licensed catteries in Croydon.
  • The requirement to provide suitable bedding did not exclude customers from bringing their own bedding. This requirement formed part of the old regulations so catteries should have already been offering such provision.
  • Inspections for general compliance of rules were normally undertaken by the Council. Inspections for annual renewal of licences were undertaken by a veterinary inspector.

 

The Committee RESOLVED to adopt the Model Licence Conditions and Guidance for Cat Boarding Establishments 2013 revised June 2016.

A32/16 ADOPTION OF THE MODEL LICENCE CONDITIONS AND GUIDANCE FOR DOG BREEDING ESTABLISHMENTS 2014

The Licensing Manager introduced the item on dog breeding and confirmed that there were no licensed breeders in the borough. If the local authority received an application, the applicant would be subject to the conditions as stated in the report. The guidance and rules had been updated and officers recommended that the Committee adopt these new regulations. If the rules were adopted, they would be published on the website to ensure that potential applicants were aware of the licence requirements. Inspections of dog breeders would be undertaken by a vet.

 

The Committee RESOLVED to adopt the Model Licence Conditions and Guidance for Dog Breeding Establishments 2014.

A33/16 ADOPTION OF THE MODEL LICENCE CONDITIONS AND GUIDANCE FOR DOG BOARDING ESTABLISHMENTS 2016

The Licensing Manager introduced the item and confirmed that there was one licensed kennel in Croydon. In 2002 the Dog Boarding Establishments rules were adopted, and an updated set of guidance and rules had since been issued. The Committee were recommended to adopt the new enhanced regulations.

 

The Committee RESOLVED to adopt the Model Licence Conditions and Guidance for Dog Boarding Establishments 2016.
