London Local Authorities Act 1990 Application for Street Designation Order

The purpose of this report is to seek the Committee’s decision on the proposal to designate six sites in the Borough as ‘licence streets’ for street trading and the granting of a street trading licence under the provisions of the London Local Authorities Act 1990 (as amended).

 

Minutes:

The Committee considered the application to designate a section of public highway outside 6-8 Tudor Court, Russell Hill Road, Purley, CR8 2LA (Appendix A).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Transport for London (TfL) maintained; TfL had stated that they were happy with the proposed designation despite the kerbside clearance being two metres and under the usually required 2.8 metres.

 

The Applicant was present and provided further comment on the application. The Applicant stated that busy times on the street were usually during the morning and early afternoon with school children commuting and that tables and chairs would not be out during these times, other than weekends. In response to questions from the Committee about the clearance for waiting staff, the Applicant stated there was a metre clearance between tables for service.

 

In response to questions from the Committee about nearby designations, the Committee heard that the nearest was on the other side of the road.

 

The Committee RESOLVED:

 

1. To designate 6-8 Tudor Court, Russell Hill Road, Purley, CR8 2LA for the      purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside 5 Crown Parade, Crown Dale, Upper Norwood, SE19 3NG (Appendix C).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Applicant was present and provided further comment on the application. The Applicant stated that flower pots had been used to mark the designation during the temporary licence period and that a resident had asked that these be moved closer to the shop window as they had presented a potential trip hazard; the Applicant had complied.

 

In response to questions from the Committee, the Licensing Manager stated that Lambeth had not been consulted over the application.

 

The Committee RESOLVED:

 

1. To designate 5 Crown Parade, Crown Dale, Upper Norwood, SE19 3NG for   the purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside 39 Limpsfield Road, South Croydon, CR2 9LA (Appendix D).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Licensing Manager explained that the site had a private forecourt and that the designation being applied for would be in addition to this.

 

The Applicant was present and provided further comment on the application. The Applicant stated that they wished to use flower bed border barriers to add greenery and to enhance the area.

 

In response to the questions from the Committee, the Applicant explained that the flower bed barriers had lockable wheels and would be stored in the restaurant overnight.

 

The Committee RESOLVED:

 

1. To designate 39 Limpsfield Road, South Croydon, CR2 9LA for the purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside 82 Church Street, Croydon, CR0 1RB (Appendix E).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Applicant was present and provided further comment on the application. The Applicant stated that the original application had been for one section for the display of mobile phones and accessories and one of food and drinks machines. During the temporary license period, it had transpired that the food and drinks aspect of the business had not been commercially viable. As a result, this had been replaced with additional mobile phone stock.

 

In response to concerns about the width of passage left for pedestrians, the Market and Street Trading Compliance Officer informed the Committee that no issues had been seen during the temporary license period. Most footfall was toward the tram platform and therefore the designation had not been an obstruction. The Licensing Manager informed the Committee that there was the ability to review the licence should issues arise in future.

 

The hours of operation requested were clarified to be 08.30 till 20.00 on weekdays and 09.00 till 19.00 on Sundays.

 

It was asked why the application had come to this committee when it had been submitted in November 2018. It was explained that the units used had taken time to build and that these were an enhancement which shrouded a potentially dangerous raised entrance to the site.

 

The Committee RESOLVED:

 

1. To designate 82 Church Street, Croydon, CR0 1RB for the purposes of street      trading.

 

2. To grant a street trading licence to the Applicant.

The Committee considered the application to designate a section of public highway outside on Bell Hill outside 34 Surrey Street, Croydon, CR0 1RJ (Appendix E).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Applicant was present and provided further comment on the application. The Applicant stated that that the hours applied for were until 3.00am to fall in line with the premises licence. The site rarely traded until 3.00am, with this normally having occurred on weekends.

 

In response to queries about an A board at the site, the Committee heard that this was dealt with under planning legislation and was not a matter for this Committee. In response to queries about patrons of the site taking up more space when smoking, the Committee was told that this was not a matter for its consideration. Rather it was the responsibility of the site to ensure that patrons did not become a nuisance. In response to queries about the addition of barriers, the Licensing Manager stated that this was a standard condition and would be included within the existing measurements in the application. The Chair noted that the barriers could act as a deterrent against pickpockets. The Committee noted that a main road ran parallel to Bell Hill and that pedestrian access should not be impeded.

 

The Committee RESOLVED:

 

1. To designate 34 Surrey Street, Croydon, CR0 1RJ for the purposes of street trading.

 

2. To grant a street trading licence to the Applicant.

 

 

The Committee considered the application to designate a section of public highway outside on 96 Brigstock Road, Thornton Heath, CR7 7JA (Appendix B).

 

The Licensing Manager introduced the item, explaining the process of designation for street trading, applying for street trading licences and the details of the application before the Committee. The Committee was informed that the application had been sent to responsible authorities and advertised in the local press; no representations had been received.

 

The section of highway in question was Croydon Council maintained.

 

The Licensing Manager noted that the site was not within the saturation area for Thornton Heath.

 

The Applicant was not present to provide further comment on the application.

 

In response to queries regarding any complaints of obstruction, the Committee heard that there had been none.

1. To designate 96 Brigstock Road, Thornton Heath, CR7 7JA for the purposes of street trading.

 

2. To grant a street trading licence to the Applicant.
